Agreement to terms
By using Slavi Kaloferov’s Services, users agree to his Legal Terms. Users must be at least 18 years old and continued use implies acceptance of any updates to the terms.
Service usage
The Services are intended for personal or internal business use and are not designed to meet industry-specific regulations (e.g., HIPAA, FISMA). Intellectual property rights of all content on the site belong to Slavi Kaloferov and CANNOT be used commercially without explicit permission.
User conduct and restrictions
Prohibited activities include unauthorised data collection, misrepresentation, security breaches, harassment and any illegal actions. Users also cannot use the Services for purposes that compete with Slavi Kaloferov’s business.
Third-party content
The Services may link to third-party websites, for which Slavi Kaloferov holds no responsibility. Users access third-party content at their own risk and should refer to those sites’ terms independently.
Service management and privacy
Slavi Kaloferov reserves the right to manage, monitor and limit access to the Services as needed. The Services are hosted in Lithuania and users consent to data processing in Lithuania. A Privacy Policy governs data use.
Termination and modification
Slavi Kaloferov may terminate user access at his discretion and is not liable for service interruptions or modifications.
Governing Law
The agreement is governed by UK law, with consumer protection provisions applicable to EU users. Legal disputes can be brought before UK or EU courts.
Dispute resolution
Users are required to attempt informal negotiation for 30 days before pursuing arbitration. Any disputes will be resolved by a single arbitrator under the rules of the European Court of Arbitration, with proceedings held in English in London. Class-action arbitration is not permitted, and exceptions to arbitration include disputes related to intellectual property and unauthorised use, which may be taken to court.
Corrections and Disclaimer
Slavi Kaloferov reserves the right to correct any errors or omissions on the Services without notice. The Services are provided “as-is,” with no guarantee of accuracy, completeness or reliability. Users assume all risks and Kaloferov disclaims all warranties, including those for merchantability, fitness for a particular purpose and non-infringement. Additionally, he assumes no liability for issues like content errors, viruses, unauthorised access or third-party advertisements.
Limitations of Liability
Slavi Kaloferov is not liable for any direct, indirect or consequential damages (e.g., lost profits, data loss) arising from the use of the Services, regardless of prior warnings about potential damages.
Indemnification
Users agree to indemnify and defend Slavi Kaloferov against any claims, damages or expenses arising from third-party claims related to users’ activities on the Services, breaches of these terms, third-party rights violations or harm to other users. Users must cooperate with Kaloferov’s defense efforts for such claims.
User data
Although Kaloferov performs routine data backups, users are solely responsible for their own data transmitted to or generated by their use of the Services, waiving claims against Kaloferov for any data loss or corruption.
Electronic communications, transactions and signatures
Users consent to electronic communications, records and signatures, agreeing that electronic documents and transactions satisfy legal requirements for written documents and signatures. Users waive any requirements for original signatures or non-electronic records.
California users and residents
California residents can contact the California Department of Consumer Affairs if their complaints with Kaloferov are unresolved.
Miscellaneous
These terms, alongside any posted policies, represent the complete agreement between users and Slavi Kaloferov. Any unenforceable provisions can be severed without impacting the remainder. These terms create no partnership or employment relationship and users agree not to use the document’s electronic format as a basis for defense.
